1. Introduction & Scope

Welcome to Linkord ("we", "us", "our"). These Terms of Service govern your access to and use of our website located at https://www.duden.de/rechtschreibung/Plattform (the "Service"), and any information, text, graphics, or other materials uploaded, downloaded or appearing on the Service (collectively referred to as "Content"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service you agree to be bound by these Terms.

2. Account Creation and Responsibility

To access certain features of our Service, such as listing a server or writing a review, you must register for an account. When you register, you agree to provide accurate, current, and complete information. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any breach of security or unauthorized use of your account. You must be at least 13 years of age to use our Service, in accordance with Discord's own Terms of Service.

3. User Content and Rules of Conduct

You are solely responsible for your Content, including server listings, descriptions, tags, and reviews. You grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your Content on and through our Service.

You agree not to post Content that:

• Is illegal, hateful, discriminatory, threatening, or incites violence.
• Infringes on any third party's intellectual property rights, including copyright and trademark.
• Contains spam, unauthorized advertising, or links to malicious websites.
• Violates Discord's Terms of Service or Community Guidelines.
• Depicts or promotes NSFW (Not Safe For Work) content on listings not explicitly marked as such.

We reserve the right, but are not obligated, to remove or modify any Content for any reason, including Content that we believe violates these Terms.

4. Listing Servers

By listing a Discord server on our platform, you warrant that you are an authorized representative of that server (e.g., owner or administrator). You are responsible for ensuring that the information provided for your server, including the invite link, is accurate and up-to-date. All listed servers must adhere to the rules outlined in Section 3. We reserve the right to remove any server listing at our sole discretion.

5. Premium Services

We may offer premium features for a fee, such as "Featured Server" status. These services are provided for a fixed term (e.g., 30 days). Payments for premium services are final and non-refundable. We reserve the right to change the pricing and benefits of our premium services at any time. The service is provided upon successful payment and ends automatically upon the expiration of the term.

6. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Linkord and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Disclaimer of Warranties and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the service will be uninterrupted, secure, or error-free. We do not endorse, and are not responsible for, the content, safety, or practices of the third-party Discord servers listed on our platform. Your use of the Service and your interaction with any listed server is at your own risk.

In no event shall Linkord, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential or punitive damages resulting from your access to or use of, or inability to access or use, the Service.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect (Severability Clause / Salvatorische Klausel).
